Captured on Canvas accepts NO responsibility or liability for copyright infringement. Captured on Canvas assumes that all images, either uploaded or sent via the post are free from copyright or the relative permission has been gained from the respective source. Any legal action that arises from copyright infringement is the sole responsibility of the purchaser and in no way is Captured on Canvas’s responsible.
By uploading your image to the Captured on Canvas website you warrant that :
- It is your own original photo or image
- You have written permission from the copyright owner
- It does not infringe any law, either state or federal
- You indeminify Captured on Canvas against any legal fees, damages or other expenses that may be incurred by Captured on Canvas as a result of your breach of the above points.
Colour representation
At Captured on Canvas every effort is made to keep colour reproduction as close as possible to your image. Colour representation can be different between monitors as it can be with viewing your image on your digital camera. By accepting our terms and conditions you knowingly accept that colour discrepancies may occur however every attempt has been made to reproduce colours accurately.
Image Alteration
After uploading your image you will have made your selected alterations i.e. cropping. If, for some reason our team believes that the image alterations supplied will produce an unsatisfactory result then we will either contact you by email or phone to discuss this further before production begins.
Damage in Transit
Captured on Canvas takes full responsibility for the delivery and arrival condition of your goods. If the canvas is damaged in anyway on receipt, your must contact Captured on Canvas within 24 hours and we will arrange to have the goods collected at a convenient time. Captured on Canvas will require a particularized account of the damage. We will reproduce the canvas for you and redeliver it as promptly as possible. Failing to meet these criteria you may forfeit a replacement canvas.
Payment
Payment can be made by any of the methods specified in the payment method of this website. By placing an order, you confirm that the credit or debit card that is being used is your own, or is being used with full authorization of the card holder. All credit and debit card holders will be subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment to us we will not be able to process your order, nor will we be liable for delay or non delivery of the product.
Once the credit card payment has been processed and payment in full for the price received, then Captured on Canvas will send you confirmation via email of your order. All payments must be made in Australian dollars.
Events beyond our control
We shall have no liability to you for any failure to deliver the product you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, industrial disputes, a breakdown of systems or network access, flood, fire, explosion, tsunami or accident.
